Welcome to GymPilot, the all-in-one fitness enrollment marketing system designed for gym owners ready to get more clients. The following terms and conditions govern all use of the GymPilot website and all content, services, and products available at or through the website.

1. ACCEPTANCE OF TERMS

By accessing and using GymPilot, you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using GymPilot's services, you shall be subject to any posted guidelines or rules applicable to such services.

2. MODIFICATION OF TERMS

GymPilot reserves the right, at its sole discretion, to modify, discontinue, or terminate the Site or Services or to modify these Terms, at any time and without prior notice.

3. ELIGIBILITY

To access or use the Site or Services, you must be 18 years or older and have the requisite power and authority to enter into these Terms. You may not access or use the Site if you are a competitor of ours or if we have previously banned you from the Site or closed your account.

4. PRIVACY

5. ACCOUNT REGISTRATION AND SECURITY

You understand that you may need to create an account to have access to all of the parts of the GymPilot Services. In consideration of your use of the Site, you will: (a) provide true, accurate, current, and complete information as prompted by the Site's registration form; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current, and complete.

6. USER CONDUCT

You are solely responsible for all code, video, images, information, data, text, software, music, sound, photographs, graphics, messages, or other materials ("content") that you upload, post, publish, or display (hereinafter, "upload") or email or otherwise use via the Service. GymPilot reserves the right to investigate and take appropriate legal action against anyone who, in GymPilot's sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators, and reporting you to the law enforcement authorities.

7. PAYMENT TERMS

Upon signing up for GymPilot services, you agree to provide accurate and complete information about yourself and your business. You are responsible for all charges incurred under your account, whether made by you or another person using your account.

8. INTELLECTUAL PROPERTY RIGHTS

The content on the GymPilot website, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to GymPilot, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions.

9. DISCLAIMER OF WARRANTIES

The site, services, content, user content, and any third-party content are provided “as is,” without warranty of any kind, either express or implied. Without limiting the foregoing, GymPilot explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, and any warranties arising out of course of dealing or usage of trade.

10. LIMITATION OF LIABILITY

In no event will GymPilot be liable to you or any third party for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your access to or use of, or your inability to access or use, the site or any materials or content on the site, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not GymPilot has been informed of the possibility of such damage.

11. INDEMNITY

12. TERMINATION

GymPilot may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately.

By using GymPilot, you agree to abide by these Terms and Conditions. If you do not agree with these terms, please do not use our services.
